• Process payments through integrated payment gateways (Razorpay, Stripe, PayPal, PhonePe, and others)
• Access multilingual support and multi-currency features for global commerce
• Utilize plugins, integrations, and third-party marketplace extensions
• Manage inventory, orders, customers, and analytics through our dashboard

3. Account Registration and Eligibility

To use LaunchMyStore, you must create an account. By registering, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction
• All registration information you provide is truthful, accurate, current, and complete
• You have the legal authority to enter into these Terms and to operate an e-commerce business
• You will maintain the security of your account credentials and notify us immediately of any unauthorized access
• You are responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are involved in fraudulent or illegal activities.

4. Subscription Plans and Payments

4.1 Free Trial: We offer a 7-day free trial that allows you to explore our platform without providing credit card information. After the trial period, you must subscribe to a paid plan to continue using the Services.

4.2 Subscription Plans: Our subscription plans are billed on a monthly or annual basis as selected during checkout. Prices are displayed on our pricing page and are subject to change with reasonable notice.

5. Merchant Responsibilities

As a merchant using LaunchMyStore, you are solely responsible for:

• All products and services you list, sell, and fulfill through your store
• Ensuring your products comply with all applicable laws, regulations, and industry standards
• Accurate product descriptions, pricing, and availability information
• Customer service, order fulfillment, shipping, returns, and refunds
• Collecting and remitting applicable taxes for your sales
• Maintaining your own privacy policy and terms of service for your customers
• Obtaining necessary licenses and permits for your business operations

6. Prohibited Activities and Content

You agree not to use LaunchMyStore to:

• Sell illegal products, counterfeit goods, or items that infringe intellectual property rights
• Engage in fraud, money laundering, or other illegal financial activities
• Sell prohibited items including weapons, controlled substances, adult content (unless permitted by your plan), or items promoting hate or violence
• Upload viruses, malware, or malicious code to the platform
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the platform's functionality or infrastructure
• Use automated systems to scrape data or overwhelm our servers
• Resell or redistribute our Services without authorization
• Violate any applicable laws or regulations in your jurisdiction

We reserve the right to remove any content and suspend or terminate accounts that violate these prohibitions without prior notice.

7. Intellectual Property

7.1 Our Property: The LaunchMyStore platform, including all software, designs, logos, trademarks, the Aqua templating engine, and documentation, is owned by TradeFusion Technologies Pvt Ltd. You are granted a limited, non-exclusive, non-transferable license to use the platform for your business purposes.

7.2 Your Content: You retain ownership of all content, products, and materials you upload to your store. By using our Services, you grant us a license to host, display, and distribute your content as necessary to provide the Services.

7.3 Themes and Plugins: Themes and plugins may be subject to additional licensing terms from their respective developers.

8. Shipping and Delivery

LaunchMyStore is a platform provider and does not directly handle shipping or delivery of products sold through merchant stores. All shipping, fulfillment, and delivery matters are the sole responsibility of the individual merchants and their customers.

We may offer integrations with third-party logistics providers, but any arrangements with such providers are between you and the logistics company.

9. Cancellation and Refund Policy

9.1 Subscription Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period.

9.2 Refunds: We offer refunds on a case-by-case basis. Requests must be submitted within 7 days of payment. Refunds are not available for partially used billing periods or after significant platform usage.

9.3 Data After Cancellation: Upon account termination, your store data will be retained for 30 days, after which it may be permanently deleted. You may request a data export before cancellation.

10. Limitation of Liability

To the maximum extent permitted by law:

• LaunchMyStore is provided "as is" without warranties of any kind, express or implied
• We do not guarantee uninterrupted or error-free service, though we strive for 99% uptime
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for disputes between merchants and their customers

11. Indemnification

You agree to indemnify, defend, and hold harmless LaunchMyStore, TradeFusion Technologies Pvt Ltd, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, your store operations, your violation of these Terms, or your infringement of any third-party rights.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms. If you disagree with changes, you may cancel your subscription before they take effect.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

14. Force Majeure

LaunchMyStore shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet service provider failures, cyberattacks, or any other event outside our reasonable control. During such events, our obligations will be suspended for the duration of the event, and we will use reasonable efforts to resume performance as soon as practicable.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

• Scheduled Maintenance: We may perform scheduled maintenance with advance notice, typically during low-traffic periods
• Emergency Maintenance: We may perform emergency maintenance without notice when necessary for security or stability
• Third-Party Dependencies: Our uptime is subject to the availability of third-party services, including payment gateways and cloud providers
